Supreme Court Takes Note of High Court Judge's Custody Order Against Advocate

The Supreme Court on Friday, May 8, 2026, took cognisance of a representation by the Supreme Court Bar Association concerning an Andhra Pradesh High Court judge's decision to send a young advocate to one day of judicial custody over a procedural error during proceedings. The case has been tentatively scheduled for hearing on May 15, according to the court's official website.
The SCBA, in a resolution dated May 6, expressed shock at the conduct of Justice Tarlada Rajasekhar Rao, stating the incident undermined judicial decorum and called for the Chief Justice of India to intervene. Through its president, Vikas Singh, the association emphasized that judicial authority should be exercised with patience, particularly toward junior advocates.
The Bar Council of India also submitted a formal representation urging immediate action, asserting that the advocate had repeatedly sought pardon and cited physical distress, but the judge remained unmoved. The BCI described the use of custody as disproportionate to the lapse.
The Supreme Court has not yet issued detailed directions but has acknowledged the representations from both legal bodies. The court is expected to examine the conduct of the proceedings and the appropriateness of the custodial order during the May 15 hearing.
