Doctors’ Association Calls for Review of Supreme Court Ruling on Post‑Death Liability
The Healthcare Reforms Doctors Association (HRDA) Telangana has demanded a national discussion and legislative reconsideration after the Supreme Court ruled that compensation proceedings in medical negligence cases may continue against the legal heirs of a deceased doctor.
HRDA said it respects the Court’s constitutional authority but cautioned that extending liability to families not involved in patient care could cause emotional, financial and psychological distress.
The association highlighted that doctors often work under high‑pressure, emergency conditions, and the ruling may worsen an already tense environment marked by violence, criminal prosecution, lengthy litigation, social media harassment and professional burnout.
HRDA warned that the decision could encourage defensive medicine, dissuade young practitioners from high‑risk specialties, and reduce medical services in underserved rural areas.
The group called on the Union Government, the Ministry of Health and Family Welfare, the National Medical Commission and other stakeholders to examine the long‑term implications of the judgment and to develop a balanced legal framework that protects both patient rights and medical professionals.
