The court cited the leaders' prior undertaking and police allegations of public disorder in its order.
Jantar Mantar, a historic landmark in New Delhi, has long been a focal point for political protests. The CJP's flag‑unfurling drew parallels to colonial‑era uprisings, according to party founder Abhijeet Dipke.
Delhi Police said Ranka and Das had deliberately trespassed the site and called for protest participation, breaching the conditions of their bonds.
The court also kept third accused Ajinkya Shinde out of custody, ordering him to post a Rs 5,000 bond and a one‑year undertaking not to disturb public peace.
Dipke arrived in Delhi this week to challenge the legality of the flag‑unfurling, arguing the act mirrors historical arrests of freedom fighters and accusing the Modi government of similar repression.
The leaders will be released after five days, but the court will monitor their compliance with the one‑year undertaking; a follow‑up hearing is set for next month.
