The Uttar Pradesh government has barred individuals who call for violent regime change from direct recruitment in state departments, corporations, councils and local bodies, as per the order issued by Principal Secretary M Devaraj. The directive clarifies that political ideology alone cannot disqualify a candidate, and that a mere registration of an FIR or a pending investigation will not automatically render a person ineligible.
Candidates deemed ineligible must have participated in an organization whose stated aim is to alter the existing order through violent means, or have taken part in such activities within three years after turning 21. The order allows that evidence of a positive change in conduct may override the presumption of continued involvement.
Samajwadi Party spokesperson Udayveer slammed the decision as a relic of the British Raj, while Congress leader Rashid Alvi called it excessive, accusing the Yogi administration of overstepping judicial boundaries. The order came amid protests in which demonstrators demanded a regime change, prompting the state to tighten character verification.
Under the new guidelines, an FIR registration or pending investigation does not automatically disqualify a candidate. Acquitted cases, settlements, or matters covered under juvenile justice law are also exempt; provisional appointments may still be issued after the candidate submits a self‑declaration and required documents.
Police and local intelligence units must submit character verification reports within 30 days of receiving a request, with the Home Department monitoring compliance. Candidates need not be present for verification, and the district magistrate must offer an opportunity for the individual to present their case before a recommendation is forwarded.
Existing government employees will not undergo fresh verification, but hiring managers must adhere to the revised process. The order takes effect immediately, and agencies will begin to assess candidates' criminal records for violent activities within the specified timeframe.
