The incident occurred on March 23, 2021, when Priyanka Gupta was walking with her three‑year‑old daughter to drop her at her father’s home. While the mother tried to pacify her crying child, Girdhari Lal, who was ironing clothes nearby, responded with the slur.
Under section 313 of the CrPC, Girdhari Lal admitted to uttering the words, yet claimed no ill‑intent. Magistrate Bains noted that the admission, combined with Gupta’s testimony, proved intent beyond reasonable doubt. The court rejected the absence of an independent witness, citing the complainant’s direct observation of the remark.
Gupta, after trying to soothe her daughter, later informed her father‑in‑law, who called the police. The court has scheduled a separate hearing to determine the sentence.
