Bombay High Court on Monday granted an eight‑month interim bail to a woman accused of trafficking six kilograms of cocaine, allowing her to remain in custody with her ailing infant daughter.
The woman, who was arrested last year by the Directorate of Revenue (DRI) for the drugs, had earlier been given a three‑month bail to give birth. On January 9, 2026, she delivered a premature girl who required prolonged NICU care.
Medical reports show the baby has a history of respiratory distress and bronchopneumonia, and was admitted to hospital in July with breathlessness, fever and acute respiratory symptoms. The infant continues to need frequent nebulisation and medication.
Justice Milind Jadhav, sitting on a single bench, noted that the child’s condition makes it impossible to provide adequate care within the prison setting. He ordered the mother to report monthly to the police station and to keep the baby in a proper hospital environment.
The court emphasised that human consideration dictates protection and medical care for the infant rather than confinement. The order reflects a balance between enforcing the NDPS Act and ensuring the child’s welfare.
The decision means the woman will now be under conditional bail, with the baby’s treatment continuing in a hospital, and the case will proceed after the bail period ends.
