Rahul Gandhi lodged a writ petition on October 12, 2026, arguing that the Election Commission’s Special Intensive Revision (SIR) of electoral rolls, decided on June 24, 2025, violated constitutional safeguards. The petition was registered by the Supreme Court Registry on October 13, 2026, after the court cleared procedural defects, and is set to be heard before Chief Justice Surya Kant and Justice Joymalya Bagchi.
The SIR, aimed at purging duplicate and ineligible names, has raised concerns that deletions were made without adequate notice or opportunity for affected voters to contest. The petition cites the Supreme Court’s 2006 verdict in TN Seshan v. Union of India, which underscored the need for transparency and due process in electoral roll revisions.
In addition to Rahul Gandhi, Congress president Mallikarjun Kharge, Samajwadi Party chief Akhilesh Yadav, RJD leader Tejashwi Prasad Yadav, NCP (SP) leader Supriya Sule and Shiv Sena (UBT) leader Sanjay Raut joined the case. They demand full disclosure of the EC’s internal files, minutes, and access‑log data, and an independent audit led by a retired judge and technical experts to verify deletions and modifications.
The hearing on October 14 will explore whether the SIR complied with Article 324 of the Constitution and the 2023 Election Commission Act. Depending on the court’s findings, the court may order a remedial audit, halt further deletions, or mandate the publication of booth‑wise deleted elector lists, setting a precedent for future electoral roll exercises.
