
On 30 September 2026 the Allahabad High Court, after a three‑year legal battle, ordered the Faizabad‑based madrasa to pay the teacher’s outstanding gratuity with 6% interest from 2019. The decision rejected the institution’s claim that the teacher’s continued service beyond the statutory retirement age of 60 justified withholding the benefit.
The teacher, who joined the institution as an assistant on 16 August 1992, worked there until 31 March 2019, retiring at 62. On 13 September 2023 the Principal Secretary of the Uttar Pradesh Minority Welfare Department denied her claim, citing only the retirement‑age rule.
Advocate Mayank Parashar of Clasis Law explained to the court that the law expressly limits grounds for denial of gratuity. He quoted a Supreme Court judgment that recognises the scheme as a protective benefit and that extending service beyond the age of 60, when permitted by the employer, cannot be used to bar payment.
The ruling signals that institutions must scrutinise each gratuity claim before issuing a denial. The madrasa has 30 days to pay the full amount, including interest, or face enforcement action.
