Benjamin Beard, known online as BenDaDonnn, was taken into custody on October 5 after a group of spectators refused police orders to clear the roadway outside The Spot, the local bar in College Station. Officers said Beard resisted, was struck, and a less‑lethal device was deployed; he was charged with evading arrest or detention and released on a $7,000 bond. The security guard who accompanied him, Kenny Carter, faced a separate charge of interference with public duties and posted a $4,000 bond.
In a livestream recorded the same day, Beard insisted the encounter was racially motivated, describing an officer who “zoned in” and “picked him” for a physical intervention. He said the police singled him out while the rest of the crowd complied, and that he was “wrongfully detained.” The streamer’s comments were punctuated by a prison‑style backdrop and a visible sign of his intention to sue.
The bond discrepancy became a focal point of Beard’s protests. He pointed to his expensive jewelry and a “Richard Mille” watch, suggesting the higher bond reflected bias. Police statements made no link between his personal effects and the bond amount, noting that the charges were determined by the nature of the alleged offenses.
The legal process is now moving forward. Beard’s attorneys will file a civil complaint within the next week, and the criminal case will be arraigned in the 22nd Judicial District Court on October 20. Court officials have not yet set a hearing date for the lawsuit, but the judge will decide how the allegations of racial profiling influence the case.
