The California Fourth District Court of Appeal, Division One, has issued a final order compelling a homeowner to cut down the remaining 19 ficus trees along a shared property line. The decision, issued in case number D085598 (Armendariz v. Renfro), ends a multi-year legal battle over invasive roots that have repeatedly crossed into the neighboring yard. The court rejected the tree owner's appeal, affirming the trial court’s authority to mandate complete removal.
This isn’t the first time these neighbors have fought. Initially, 38 ficus trees lined the boundary between the two Southern California homes. The fast-growing species, popular for privacy screens, developed aggressive underground root systems that wrecked landscaping and threatened nearby structures. To avoid a full-blown court war, the parties struck a deal: the tree owner paid $78,500 in damages, and both agreed to remove exactly half the row. Nineteen trees went down. The other 19 stayed.
It didn’t work. The roots from the remaining trees kept growing. They crossed the line again, causing further damage despite the earlier payout and partial removal. The affected neighbor, tired of the recurring nuisance, returned to court demanding a permanent fix. The trial court sided with them, ordering the removal of the rest of the hedge. The tree owner appealed, arguing the order was excessive, but the appellate court found the partial settlement had failed to stop the ongoing intrusion.
The appellate panel concluded that removing the final 19 trees was a necessary and reasonable step to end the conflict. The opinion, while unpublished, sets a clear precedent for boundary disputes involving invasive vegetation in the region. The court noted that financial compensation alone was insufficient to remedy the physical encroachment of the roots.
The homeowner must now remove the trees within the timeframe set by the lower court. Failure to comply could result in contempt of court orders or further financial penalties. For now, the privacy hedge is gone, and the legal fight is over.
