The couple had agreed to purchase the unit in December 2019, with Jake contributing $359,949.42 and Millie $159,678. The deed, signed with their law firm, reflected the lopsided split and was recorded in March 2020.
After their separation in November 2020, Jake sought a declaration that his larger financial input created a resulting trust, arguing he would receive 71% of the property’s benefit.
A High Court judge initially found that 54.22% of Millie’s legal share was held on trust for Jake, based on a 55.22% / 44.78% split calculated from contributions.
Chief Justice Sundaresh Menon’s panel rejected Jake’s shifting “cheating condition” and future‑purchase clause, noting the lack of documentary evidence and his contradictory affidavits. The court reaffirmed that the written 99:1 split represented the parties’ true intention.
