Saini arrived in Australia in 2025 after her brother suffered a brain haemorrhage on 1 November 2025, and has since lived in Ballarat, Victoria, to manage his affairs. She has spent more than $40,000 on visa applications, living costs and the probate process, and has been barred from working due to the 8503 condition on her visa. The condition prohibits holders from applying for other visas in Australia without a waiver, which was denied when she applied for an extension in August 2026. Immigration lawyer Jordan Tew highlighted that the system must allow greater flexibility for those handling a deceased relative’s estate, warning that extending condition 8503 to all visitor visas could trap many in similar situations. Saini said she feels “on the brink of breaking down,” will miss her brother’s memorial service scheduled for November, and plans to return to India later this month to complete the settlement from abroad.
