The Jammu and Kashmir High Court has imposed a strict ban on the operation of all fuel-powered motorboats and jet skis in Dal Lake, a move aimed at protecting the lake's fragile ecosystem. The division bench, comprising Chief Justice Dr Pushpendra Singh Bhati and Justice Rajesh Sekhri, issued the directive in response to a petition highlighting the environmental damage caused by motorized vessels in the lake. The court emphasized the need for a regulated and protective approach to preserve Dal Lake's ecological balance.
In its order, the bench explicitly stated that no fuel-powered motorboat, whether a traditional shikara or a jet ski, is permitted to operate in Dal Lake until further orders. The court directed the Lakes Conservation and Management Authority (LCMA), the Tourism Department, and the Police to ensure strict compliance with this prohibition. The order specifically warned that any violation would be treated as contempt of court, signaling a zero-tolerance approach to the ban.
The court recognized the operational needs of government and emergency services, exempting boats used for law and order, disaster management, and safety from the prohibition. However, the bench stressed that these exemptions are limited to official use and do not extend to commercial or recreational motorized boats. The court also urged the government to explore the feasibility of solar-powered e-engines as a viable alternative to fuel-powered vessels.
The petition that led to this order argued that the proliferation of motorboats and jet skis in Dal Lake is causing significant harm to its ecosystem. The court's decision reflects a broader concern about the environmental degradation of the lake and the need for sustainable tourism practices. The order underscores the judiciary's role in balancing economic interests with environmental protection.
Going forward, the LCMA, Tourism Department, and Police are tasked with enforcing the ban and monitoring compliance. The court has directed these authorities to take a strict view of any violations, ensuring that the prohibition is effectively implemented. The government is also expected to develop a comprehensive policy on the operation of motorized boats in Dal Lake, with a focus on transitioning to eco-friendly alternatives.
