According to the filing, Virginia received pre‑operative medication before the extraction, and at about 9:20 a.m. the dentist administered a local anaesthetic that, the court alleges, was inadvertently injected into a blood vessel. Minutes later she suffered two brief tonic‑clonic seizures, stopped breathing, and her pulse vanished; an ambulance was summoned, and she was pronounced dead at a nearby health centre.
The autopsy, reported by the Winnipeg Free Press and CTV News, concluded that Virginia succumbed to local anaesthetic systemic toxicity. The lawsuit lists a litany of alleged failures: injecting into a blood vessel instead of tissue, neglecting to suction blood from the syringe, administering an excessive dose, failing to monitor for signs of toxicity, and not promptly starting lipid‑emulsion therapy.
Janz, who has held a dentist licence since 2015, carries restrictions in the Manitoba Dental Association registry that require supervision when giving local anaesthetic and limit sedation services. The clinic is also accused of insufficient staff training, inadequate emergency protocols, and a lack of readily available antidotes and oxygen. No defence statements have yet been filed by the defendants.
The family seeks compensation under Manitoba’s Fatal Accidents Act and funeral‑related expenses. The court has set a pre‑trial conference for January 2027, where both sides will present evidence and arguments.
