Shailendra Mani Tripathi filed a petition under Article 32 in the Supreme Court of India in 2026, demanding that the Election Commission restore the original Form 6 and investigate the deletion of 13 crore names from draft electoral rolls.
The petition accuses Chief Election Commissioner Gyanesh Kumar of unilaterally amending Form 6 during the Special Intensive Revision (SIR) and of issuing software modifications that, according to Commissioners Sukhbir Singh Sandhu and Vivek Joshi, violate the Registration of Electors Rules, 1960.
The Election Commission maintains that no change was made to Form 6 itself, arguing that the new declaration was added as a separate annexure; Tripathi insists that this annexure effectively altered the statutory form.
Tripathi also seeks an independent inquiry headed by a retired Supreme Court judge, backed by cybersecurity experts, to examine the removal of over 13 crore names from draft rolls across 30 states and Union Territories as of September 1.
The petition further calls for prosecution under Section 32 of the Representation of the People Act 1950 against Gyanesh Kumar, Deputy Election Commissioner Maneesh Garg, and IT chief Seema Khanna, citing alleged breaches of official duty.
The Court is expected to set a hearing date in the coming weeks, after which it will decide whether to order the inquiry or dismiss the petition.
