The Delhi High Court, on Friday, threw out Neha Bora’s challenge to a police notice demanding a Rs 10,000 peace bond with a surety.
The notice, issued on Oct 17 under Section 126 BNSS, instructs Bora to appear before a Special Executive Magistrate on Oct 19 and explain why she shouldn’t be bound.
Bora’s lawyer, Gopal Sankaranarayanan, called the notice a “cut‑and‑paste” copy, arguing the magistrate had not applied any mind to the case and that citizens need not seek permission to hoist a flag.
Delhi Police’s Additional Solicitor General, Chetan Sharma, countered that the magistrate had ample material and that the notice was maintainable under the law.
Bora, a student leader vocal against alleged Election Commission roll‑revision irregularities, was briefly locked up on Oct 16 while heading to a protest march and released the next day.
The High Court left the decision on whether Bora must post the bond immediately to the Special Executive Magistrate, who will decide before the inquiry concludes.
