After the Oct 10 protest in Mumbai, Mumbai Police served Imran Khan a departure order, citing his participation in the demonstration demanding the resignation of Chief Election Commissioner Gyanesh Kumar.
Mahesh Jethmalani, a former BJP Rajya Sabha member, argued that Khan, as an OCI holder, has no right to protest in India and that the order is supported by Section 7(2)(C) and Section 29 of the Immigration and Foreigners Act.
He warned that any OCI can only enjoy civic privileges if he obeys Indian law, urging Khan to take his protest to the United States where he is a citizen.
Khan will file a petition in the Bombay High Court to challenge the notice, and the court has scheduled the hearing for the first week of November.
