When Melissa Azrack gave birth to a daughter in 2017, she and the deceased Malcolm Dorman signed a sperm‑donor contract that barred any parental claims from him.
Dorman, who died in March 2021, later described himself as the girl's biological father in his will and left her as a beneficiary of a trust.
The trial judge found the contract valid, concluded Dorman had waived his rights, and held that the house at 443 Ocean Boulevard was not a protected homestead, removing any legal basis for the daughter’s claim.
The Third District Court of Appeal, agreeing with the lower court on both points, upheld the denial, noting that a challenge to the father‑status ruling would not alter the property outcome.
Azrack, who has fought a series of procedural battles—including a judge‑removal request—argues the daughter should inherit the house, but the court’s decision leaves the estate intact and the daughter without a legal path forward.
